A typical hearing is scheduled for a morning (4 hours) or one day (8 hours). A schedule structure is used whereby time is allocated for the following:

  • Pre-reading by Judge of materials previously provided by the parties, as applicable (60)
  • Introductions and outline of Hearing Procedures (20)
  • Claimant – submissions and presentation of supporting evidence (20)
  • Respondent – submissions and presentation of supporting evidence (20)
  • Questions & Cross-Examination – both parties facilitated by the Judge (30)
  • Claimant – final submission (15)
  • Respondent – final submission (15)
  • Judge – communication of decision and next steps (60)

Fees: Fixed time and fixed fee options are intended to suit a wide variety of circumstances and budgets, including small claims matters.

Can I Get Legal Advice Via Video Or ‘Phone? Yes.

Especially in light of COVID-19 travel and social distancing restrictions, legal advice can be offered via telephone or via video using common video platforms that everyone can access, such as Zoom. In other words, advice can be provided and disputes can be resolved without anyone having to leave their home. We use a state-of-the-art platform specifically desgined for the management of any hearings or negotiations we host, including fully-encrypted communications. No technical experience is necessary – it is very simple and intuitive to use. The only requirement is an internet connection.

What Does Representation Cost?

Simple fixed time and fixed fee pricing options are available – and also bespoke package options in more complex cases – bringing most services well within reach for everyone. In some cases, there may be public funding available and increasingly there are private funding options also. It’s always worth asking.

Do You Carry Insurance? Yes.

David holds £1 million in professional liability insurance, which may be increased on a matter-to-matter basis – based on the facts of the situation under consideration.

Is Our Conversation Confidential? Yes.

In short, lawyer-client communications are privileged (which is lawyer-speak for confidential) – except in very rare circumstances, which are unlikely to occur.

COVID-19 ALERT: Hearings ordinarily conducted in person may be held remotely via online video. With the extensive travel limitations and Court hearing delays caused by COVID-19, video hearings represent the quickest, least expensive and most efficient way to resolve a dispute satisfactorily – allowing those involved to put it behind them and move forward.
